This Privacy Policy explains what information we collect, why we collect it, how we use it, how long we keep it, and the choices you have. It applies to this website and to the services provided by Craig Holdings, LLC, which operates as Lease Genie.

1. Who collects your information

The company responsible for your information, sometimes called the data controller, is Craig Holdings, LLC, operating as Lease Genie, located in Omaha, Nebraska, United States. We serve business customers in all 50 states, including Alaska and Hawaii.

2. What information we collect

We collect the following categories of information, and only what is reasonably needed for the purposes described in section 3.

Information you give us

• Identifiers and contact details. Your name, company name, business email address, telephone and mobile numbers, and business mailing address.
• Enquiry details. What you are looking to finance, the amount, your timeline, and how you heard about us.
• Commercial and credit application information. When you apply for financing: business details, time in business, financial statements and bank information, tax identification numbers, and personal credit information for an owner or guarantor where a personal guarantee is part of the transaction.
• Communications. Emails, text messages, call notes, and recordings where a call is recorded and you have been told so at the time.
• Messaging preferences. Whether you have agreed to receive service messages or promotional messages, and when that agreement was given or withdrawn.

Information collected automatically

• Device and usage information. Browser type, device type, pages viewed, and the approximate general region derived from an IP address, used to keep the site working and secure.
• Cookies and similar technologies. Used to operate the site, remember your preferences, and understand which pages are useful. You can control cookies through your browser settings.

3. How we use your information

• To respond to your enquiry and to schedule and confirm appointments.
• To assess, prepare, submit and process an application for equipment financing, leasing or working capital that you have asked us to pursue.
• To keep you informed about the status of your application, including document requests and funding milestones.
• To prepare and deliver financing documents for signature.
• To provide customer service and to maintain our records of our relationship with you.
• To send promotional messages, but only where you have separately agreed to receive them, and you can withdraw that agreement at any time.
• To comply with our legal, regulatory, tax and record keeping obligations, including obligations that apply to commercial finance.
• To protect the security and integrity of our systems and to prevent fraud.

4. Text messaging and your consent

Consent to receive text messages is always optional and is never a condition of applying for or receiving financing. When you book a call or submit a request through our booking page, you are offered two separate optional checkboxes: one for service and transactional messages about your account and your application, and one for marketing and promotional messages. Both are unchecked by default, and you may accept one, both or neither.

Message frequency may vary. Message and data rates may apply. You may reply STOP at any time to opt out of further messages, or HELP for assistance. Full messaging terms are set out in our Terms and Conditions.

5. How we share information

We do not sell or rent your personal information, and we do not share it with third parties so that those parties can market to you. We share information only in the limited circumstances below.

• Funding sources, at your request. We are a commercial finance brokerage. When you ask us to obtain financing, we submit your application and supporting documents to lenders, lessors and funding partners for the purpose of obtaining an offer for you. This happens only for an application you have asked us to pursue, and only to obtain financing, never for marketing.
• Service providers. Companies that operate our business systems on our behalf, such as our customer relationship platform, electronic signature provider, email and telephone providers, and accounting software. They may use your information only to perform services for us and are bound to protect it.
• Professional advisers. Our accountants, auditors and lawyers, where reasonably required.
• Legal and regulatory. Where we are required to disclose information by law, by a court order, or by a lawful request from a public authority, or where disclosure is necessary to establish or defend legal claims or to prevent fraud.
• Business transfer. If our business is sold or reorganised, your information may transfer as part of that transaction, subject to this policy.

6. How long we keep your information

• Enquiries that do not become applications. Kept for up to 24 months from your last contact with us, so that we can pick up the conversation if you come back to us.
• Financing applications and funded transactions. Kept for the life of the transaction and then for a minimum of 7 years after it closes, to meet financial, tax and regulatory record keeping requirements.
• Messaging consent records. Kept for as long as you remain a contact and for at least 4 years after consent is withdrawn, because we are required to be able to evidence when consent was given and withdrawn.
• Website and usage data. Kept for up to 26 months.

When a retention period ends, information is deleted or anonymised.

7. How we protect your information

We use administrative, technical and physical safeguards appropriate to the sensitivity of the information, including encrypted connections on this website, access controls that limit who can see application data, and reputable vendors for document signature and storage. No method of transmission or storage is completely secure, so we cannot guarantee absolute security, but we take these obligations seriously and review them.

8. Your rights and choices

• Access. Ask for a copy of the personal information we hold about you.
• Correction. Ask us to correct information that is wrong or incomplete.
• Deletion. Ask us to delete your information, subject to the record keeping obligations described in section 6.
• Withdraw consent. Opt out of text messages by replying STOP, or opt out of marketing emails using the unsubscribe link in any marketing email. Service messages about an active application may continue unless you ask us to stop those too.
• Opt out of sale or sharing. We do not sell or share personal information as those terms are used in United States state privacy laws, so there is nothing to opt out of, but you may still contact us to confirm this.
• Non discrimination. We will not treat you differently or refuse you service for exercising any of these rights.

To exercise any right, contact us using the details in section 12. We will verify your identity before acting on a request and will respond within the time required by applicable law.

9. Age restriction

Our services are offered to businesses and to individuals who are 18 years of age or older. This website and our messaging programs are not directed to children, and we do not knowingly collect personal information from anyone under 18. If you believe a child has provided us with information, contact us and we will delete it.

10. Links to other websites

Our site and our messages may link to websites we do not operate, such as an electronic signature provider or a funding partner. We are not responsible for the privacy practices of those websites, and we encourage you to read their policies.

11. Changes to this policy

We may update this policy from time to time. When we do, we will change the effective date at the top of this page. If a change is significant, we will take reasonable steps to tell you. Continuing to use our website or our services after a change means you accept the updated policy.
