Terms and Conditions, including Messaging Terms

These Terms and Conditions govern your use of this website and your participation in the text messaging programs operated by Craig Holdings, LLC, which does business as Lease Genie. By using this website or by agreeing to receive text messages from us, you accept these terms. If you do not accept them, please do not use the site or agree to receive messages.

1. About us

Lease Genie is the operating name of Craig Holdings, LLC, a limited liability company based in Omaha, Nebraska, United States. We are a commercial finance brokerage. We arrange equipment leasing, equipment financing, working capital and commercial real estate financing for businesses in all 50 states, including Alaska and Hawaii, and we operate a referral partner program for equipment vendors.

We are not a bank. We are not a depository institution. We do not offer debt relief, debt consolidation or debt forgiveness services, and we do not offer investment products or investment advice.

2. Financing is subject to approval

Nothing on this website is an offer of credit, a commitment to lend, or a guarantee of approval. All financing is subject to credit review, underwriting and approval by the applicable funding source. Rates, terms, payment amounts, structures and approval decisions vary by transaction and are determined case by case. Any figures discussed before a written term sheet or a signed agreement are estimates and are not binding.

3. Our messaging program

We operate text messaging to support the financing relationship you have asked us to enter into. The program is described below so that you know exactly what you are agreeing to before you agree to it.

Service and transactional messages

If you agree to receive service messages, these relate to your account, your enquiry, or the financing you have requested. They include:

• Appointment confirmations, reminders and changes
• Replies to a question you have sent us
• Requests for documents needed to complete your application
• Updates on the status of an application, including approval, documentation and funding milestones
• Notices that financing documents are ready for signature
• Notifications about an active transaction or account

Marketing and promotional messages

If you separately agree to receive marketing messages, these may include financing program updates, seasonal equipment financing offers, vendor partner program news, and occasional information about services we think may be useful to your business. This is a separate, optional agreement from the service messages above.

4. Message frequency, rates and how to stop

• Message frequency may vary. The number of messages you receive depends on the stage of your application and how much contact is needed to move it forward.
• Message & data rates may apply. Any charges come from your mobile carrier, not from us. Check your plan if you are unsure.
• To opt out, reply STOP to any message from us at any time. You will receive one confirmation that you have been unsubscribed, and then no further messages in that program.
• For help, reply HELP to any message from us, or contact us using the details in section 11.
• You may also opt out by calling or emailing us, or by asking us on a call.
• Opting out of marketing messages does not stop service messages about an active application, and opting out of service messages may mean you need to call us for updates instead.

5. Carrier disclaimer

Mobile carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission by your mobile carrier and is outside our control. We do not guarantee that any message will be delivered, and we are not responsible for messages that are delayed, undelivered or misdirected by a carrier or a device. Supported carriers may change from time to time without notice.

6. Age restriction

This website and our messaging programs are intended for business use by people who are 18 years of age or older. By using this site or agreeing to receive messages, you confirm that you are at least 18 and that you are authorised to act for the business you represent. We do not knowingly collect information from, or send messages to, anyone under 18.

7. Your responsibilities when you give us a mobile number

• You confirm that the mobile number you give us is yours, or that you are authorised to agree to receive messages at that number.
• You agree to tell us promptly if the number is reassigned or is no longer yours.
• You agree not to use our messaging or our website for any unlawful purpose or in a way that interferes with our systems.
• You agree that the information you give us in an enquiry or an application is accurate and complete to the best of your knowledge.

8. Your privacy

How we handle your information is set out in our Privacy Policy, which forms part of these terms. In short: we do not sell or rent your personal information, and your mobile number and messaging consent are never shared with any third party for that party's own marketing.

9. Website content and intellectual property

The content on this website, including text, layout, graphics and the Lease Genie name and logo, belongs to Craig Holdings, LLC or is used with permission, and is protected by intellectual property laws. You may view and print pages for your own business use. You may not copy, republish or use our content commercially without our written permission.

The information on this site is general information about our services. It is not financial, tax, accounting or legal advice, and it does not take account of your particular circumstances. You should take your own professional advice before entering into a financing agreement.

10. Limitation of liability

This website is provided on an as is basis. To the fullest extent permitted by law, Craig Holdings, LLC is not liable for any indirect, incidental, special or consequential loss arising out of your use of this website or our messaging programs, including any loss of profit, loss of business or loss of data. Nothing in these terms limits any liability that cannot be limited by law.

11. Changes to these terms

We may update these terms from time to time. When we do, we will change the effective date at the top of this page. Continuing to use the website or our messaging programs after a change means you accept the updated terms.

12. Governing law

These terms are governed by the laws of the State of Nebraska, United States, without regard to its conflict of law rules. Any dispute arising from these terms or from your use of this website will be handled in the courts located in the State of Nebraska.
